Pre Contract Information and Shadow Paper Cuts Terms and Conditions of Sales
This document contains important information. You should read it thoroughly before buying from Shadow Paper Cuts and entering into a contract with us. They relate to all sales made through selling platforms and via direct connect through Facebook messenger, email, over the telephone or via standard order form face to face and by placing an order you hereby agree to be bound by these terms and conditions.
Additional terms and conditions may apply for prize competitions, online bidding and give-aways. They will be highlighted, as and when these circumstances arise.
We may revise these conditions from time to time. We advise you to regularly check to keep yourself fully informed as they are binding to you. If you access or websites or any other selling platforms then you are agree to be bound by our terms and conditions. A copy of these terms and conditions can be found on both websites and can be printed out should you wish.
Websites and online selling platforms are owned and operated by Shadow Paper Cuts. If you have any questions or comments you are welcome to contact us via telephone 09:00-15:00 Monday and Friday and 8:00 -12:00 Wednesday) mobile phone rates will apply or e mail.
These terms and conditions, their validity, construction and performance of this agreement shall be governed by English Law. Emma Williams is the sole proprietor of Shadow Paper Cuts, established April 2014 and the registration address and contact details are as follows-

“The Buyer, You or Your” refers to the person or company with whom a contract is made.
“The Goods” refers to any item that is the subject of any order by The Buyer whether via online selling platforms, via standard order form face to face or via a direct contact such as Facebook message or e mail and agreed to be sold by Shadow Paper Cuts to the Buyer.
“We, Us, Our” refers to Shadow Paper Cuts.
“Working Days” are Monday-Friday and exclude weekends and bank holidays.
“Online Selling Platform” refers to online selling markets such as Etsy.com, stallandcraftcollective.co.uk in which we hold an online market stall or shop in which we use to sell our Goods.
1.1 These Goods include hand cut framed paper cuts and gift cards but can include any products listed on our website or online selling platforms.
1.2 All products as depicted on this website and other selling platforms are for UK deliveries only. Deliveries outside of the UK can be discussed but at our own discretion.
1.3 All bespoke designs are the property of Shadow Paper Cuts and we reserve the right to incorporate them into the main range of Shadow Paper Cuts.
1.4 All designs remain the property of Shadow Paper Cuts and may not be reproduced or copied in any format, without permission.
1.5 Designs may be photographed and used for the marketing or promoting of Shadow Paper Cuts.
1.6 Due to the handmade nature of our products, there may be slight variations in each piece of any particular design; for example colour, size and shape of completed items and their components. They are cut by hand unless otherwise stated, and every design is truly unique, even designs that are cut from the same template will vary.
1.7 We make every effort to faithfully measure the size of the goods but all sizes are approximate.
1.8 Any images supplied by The Buyer, for reproduction must be free of copyright, your property or supplied with the permission of the originator at your request.
1.9 We reserve the right to refuse to reproduce anything of an offensive or illegal nature or anything which to our knowledge breaches current copyright laws and will not accept any responsibility, for breach of copyright on any materials supplied by the customer.
1.10 The following change requests will not incur any additional costs: Colour change to background or overall design colour.
1.11 In most cases of bespoke/personalised design, we will email The Buyer a proof for The Buyer to confirm. Changes to artwork can take up to a further 5 working days to action.
1.12 It is The Buyer’s responsibility to check carefully any spelling, punctuation, dates, grammar and information that has been supplied to us is correct and the proof has been carefully checked before signing it off. Once the Buyer has signed off a design we will not be able to make any further changes.
1.13 If the Buyer has confirmed a design incorrectly then we will not be liable for any cost to replace the product or to have the goods returned. In these cases we reserve the right to charge a fee for the item to be remade in most cases this is 60% of the total cost.
1.14 Shadow Paper Cuts is entitled to withdraw from any contract in the case of obvious errors or inaccuracies regarding the Goods. If this is the case we will e mail you as soon as possible to inform you of the correct product or price and ask if you wish to continue with the order with amendments or whether to cancel. If the order is cancelled we will refund the entire value of the order as soon as possible but within 7 working days the refund will be made on to the original form of payment.
1.15 We reserve the right to change, modify, substitute or remove products or information without notice.
2.1 VAT is charged at the current rate and is included in the prices given on the website and other online selling platforms.
2.2 All prices on our websites and selling platforms are subject to change. We reserve the right to change prices without notice. All orders and quotes made prior to the changes will not be affected.
2.3 The Buyer must understand that colours in the images displayed on websites and on screen may vary slightly from the colours on the product. This is because colours vary from screen to screen. We strongly advise that if The Buyer is unsure of colours to request a sample.
2.4 All quotes are valid for 7 days only.
How Payments Can Be Made
3.1 Payments can be made on any online selling platform via their websites in accordance with their terms and conditions.
3.2 Direct orders via social networking sites, telephone or e mail can be paid for using any of the following methods; credit and debit cards (Visa credit or debit, MasterCard and Maestro) PayPal, direct bank transfer or cash.
3.3 We will confirm receipt of payment usually via email in most instances.
4.1 All framed products are made to order, no stock is held for immediate delivery.
4.2 Due to the handmade and hand cut nature of these Goods, dispatch can be made from 1-3 weeks, starting from the day after the order has been placed depending on framing requirements and busy periods such as Valentine’s Day, Mother’s Day and Christmas.
4.3 If an order cannot be met within The Buyer’s statutory 30 day period, we will contact the Buyer to advise of a revised date as soon as possible.
4.4 Deliveries are dispatched mostly using Royal Mail, although we reserve the right to use couriers for larger items as we see fit.
4.5 The price of delivery is stated on the websites and online selling platforms, deliveries are usually made using 1st class post and take between 1-3 days but we reserve the right to post larger items using 2nd class to keep the overall postage cost down and expect these to be delivered within 3-5 days.
4.6 The Buyer can request for delivery to be 1st class or signed for delivery and we reserve the right to charge extra accordingly.
4.7 Items are not classed as missing until a period of 14 working days has been reached at which point The Buyer must inform us in writing of a missing item.
4.8 Unfortunately some situations are beyond our control and we will not be made liable to The Buyer if the delay or failure was due to any of the following-
* Act of God, explosion, flood, fire or accident.
* Strikes or other industrial actions or trade disputes.
* Ill health.
4.9 Shadow Paper Cuts does everything to ensure that The Buyer is completely satisfied and the Goods they receive are in the condition they were sent. To ensure this, all our frames are well packaged in foam lined boxes and fully gift wrapped free of charge, we advise retaining the original packing material for your reference.
5.1 If for any reason the Buyer is dissatisfied with a product from our generic stock range (i.e. excluding bespoke/personalised products) purchased from Shadow Paper Cuts, under the distance selling regulations the Buyer may cancel their order for a full refund up to 7 days after receipt of the Goods.
5.2 The Buyer must inform us of their decision to cancel/return the order in writing by either post or email.
5.3 Goods must be returned in the same condition that they were sent at the Buyer’s expense within 7 days of receipt we recommend that you obtain proof of postage, as we cannot be held responsible for goods that fail to reach us.
5.4 The Buyer will be responsible for any Goods that have been damaged in transit when being returned so must ensure that the Goods are well packaged. To avoid this we advise using the original packaging.
5.5 Only when Goods are faulty/damaged and returned to us are we able to either offer a full refund or send a replacement product.
5.6 If a fault is found with generic Goods that is the responsibility of Shadow Paper Cuts then we will arrange for the faulty Goods to be collected and the Goods will be replaced at cost to us or a full refund will be offered.
5.7 IMPORTANT current distant selling regulations state that bespoke and personalised items are not eligible for a refund but a replacement product will be sent to replace any damaged Goods once proof has been provided. Therefore we regret once payment has been received for bespoke and personalised Goods we are unable to offer refunds unless in very exceptional circumstances and at our own discretion.
5.8 If the fault with the Goods is found to be because The Buyer has confirmed a design or entered information incorrectly we will not be liable for any cost to replace the Goods or to have the Goods returned. In these cases we reserve the right to charge a fee for the item to be remade should the Buyer require. In most cases this is 60% of the total cost.
5.9 Any refunds can only be made back to the same payment method that has been used to purchase the Goods. We are unable to refund money into another name or account.
6.1 Most frames supplied are handmade especially for us by an external company.
6.2 The frames are mostly Perspex in order to minimise breakage and weight. Therefore great care should be taken when cleaning the Perspex. It should be wiped gently with a lint free soft cloth or dusted over with a soft feather duster to avoid scratches on the surface of the Perspex.
6.3 Any paper cut sold as “shadow framed” must be kept away from heat sources or over time your paper cut may slip.
6.4 Returns are not accepted after 1 year due to slippage. This does not affect your statutory rights.
6.5 Paper cuts that are framed in this manner are very delicate and care should be taken when displaying and handling.
Data Protection and Privacy
7.1 We value customer privacy, working on a non-disclosure basis we do not pass on client information to third parties, except for the needs of product delivery.
7.2 In order to process an order we have to collect your name, address, e-mail address, telephone number. If you would prefer not to receive information from Shadow Paper Cuts on promotions please email and a note will be made.
8.1 Shadow Paper Cuts has a number of social media outlets, which we invite the public to follow/like us on.
8.2 Most online communities have their own rules and guidelines, which we will always follow. We reserve the right to remove any contributions that break the rules or guidelines of the relevant community.
8.3 Shadow Paper Cuts may choose to follow/like or otherwise establish connections with other organisations and individuals using social media. This is so we can maintain contact with what other social media users are saying and, where appropriate, share their content. Sometimes we also need to establish a connection so that we can engage with users, e.g. via direct messages or posting.
8.4 Shadow Paper Cuts does not endorse any individual or organisation merely by virtue of creating a social media connection, regardless of the terms used by social media providers such as follow/like.
8.5 Any comment left on any social networking site can be used by Shadow Paper Cuts in websites, newsfeeds and testimonials to advertise or promote Shadow Paper Cuts.
8.6 This is an emerging area of communications and as such we will review and amend its practice continuously.
8.7 We cannot be held responsible for any content posted by third parties to any or our online services. Every effort will be made to remove any inappropriate material promptly.
